5. Website use and intellectual property

Unless otherwise stated, all original artwork, artwork images, written content, branding and creative materials displayed on this website are protected by applicable intellectual property law.

Copyright in Justin Butler's original artwork remains with the artist unless expressly transferred through a separate written agreement.

Purchasing an original painting or print transfers ownership of the physical item but does not transfer copyright or reproduction rights.

Website material must not be reproduced or commercially exploited without permission, except where permitted by law.

We take reasonable care to ensure website information is accurate but may update descriptions, availability and other content where necessary.

6. Artwork sales and consumer rights

Original paintings and limited-edition prints are sold by Anthemics Limited, trading as Justin Butler Art.

Product descriptions

We aim to provide accurate information about each artwork, including its dimensions, materials, framing, edition and availability.

Original paintings are individually produced and may feature intentional variations in texture, surface and finish.

Colours may appear differently depending on lighting, photography and screen calibration. This does not affect statutory rights where goods fail to conform to their description.

Prices and payment

Prices are displayed in pounds sterling.

The total purchase price, including any applicable taxes and delivery charges, will be displayed before checkout is completed.

Payment is processed using the payment methods made available at checkout.

Orders

Submitting an order constitutes an offer to purchase. A contract is formed when we accept the order, as confirmed by an order acceptance or dispatch confirmation.

If an artwork becomes unavailable or an order cannot be fulfilled, we will contact you and refund any payment received for the unavailable item.

Delivery

Delivery options, charges and applicable timescales are provided during checkout or on our Delivery & Returns page.

Unless otherwise agreed, goods will be delivered within 30 days of the contract being formed.

Risk of loss or damage generally remains with us until the goods come into the physical possession of the customer or a person identified by the customer to receive them, subject to applicable legal exceptions.

Cancellations and returns

Consumers purchasing online generally have the right to cancel eligible purchases within 14 days after receiving the goods, without giving a reason.

Exceptions may apply to qualifying personalised or genuinely made-to-specification artwork, where the law permits.

Standard original paintings and limited-edition prints are not automatically exempt simply because they are handmade or limited in number.

The procedures, return costs, refund arrangements and any lawful exceptions are explained on our separate Delivery & Returns page.

Nothing in these terms affects statutory rights relating to faulty, damaged, misdescribed or otherwise non-conforming goods.

Commissions

Bespoke artwork commissions may be governed by separate written terms agreed before work begins. Those terms will address the brief, fees, stages of approval, delivery and applicable cancellation rights.

7. Limitation of liability

Anthemics Limited takes reasonable care in operating this website and fulfilling customer orders.

The following provisions apply only to the extent permitted by applicable law and do not restrict statutory consumer rights.

Website availability

We do not guarantee uninterrupted access to this website or that it will be completely free from technical errors.

We are not responsible for website interruptions, third-party service failures or temporary technical problems where we have not breached an applicable legal duty.

General website information

Information and content on this website are provided for general informational and artistic purposes.

We are not responsible for losses arising from reliance on such information where no legal duty has been breached.

Artwork appearance

We make reasonable efforts to represent artwork accurately. Variations attributable to screen calibration, photography and lighting do not, in themselves, constitute defects.

This provision does not limit a customer's rights where the goods are not as described or otherwise fail to meet statutory requirements.

Financial liability

We are responsible for loss or damage caused by our breach of contract or negligence where such loss or damage was reasonably foreseeable.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

For consumer purchases, we are not responsible for business losses, including loss of profit or business opportunity, where the artwork was purchased for private use.

Where legally permissible and fair in the circumstances, our total contractual liability in connection with a particular purchase shall be limited to the amount paid for the affected artwork.

This limitation does not apply where it would exclude or restrict a customer's statutory rights or other liability that cannot lawfully be limited.

Events beyond our reasonable control

We are not responsible for delays or failures caused by events genuinely beyond our reasonable control, except to the extent that applicable law requires otherwise.

Where such circumstances arise, we will take reasonable steps to notify affected customers and minimise disruption.

Liabilities that cannot be excluded

Nothing in these terms excludes or restricts liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Breach of statutory consumer rights where exclusion or restriction is prohibited.

  • Any other liability that cannot lawfully be excluded or restricted.

Nothing in this section affects your statutory rights.

8. External links

Our website may contain links to third-party platforms, including Instagram, TikTok and external services.

Third-party websites operate under their own terms and privacy policies.

We are not responsible for the content or practices of independent third-party services, except where liability arises under applicable law.

9. Changes to these terms

We may update these terms and policies to reflect changes in legislation, website functionality or business operations.

Updated versions will be published on this page with the revision date.

Changes to website terms will not retrospectively remove rights under contracts already formed.

10. Governing law

These terms are governed by the laws of England and Wales.

Consumers retain the benefit of mandatory protections applicable in their place of residence and any rights they have to bring proceedings in courts with jurisdiction under applicable law.
